Online Poker in India

There are many websites which offer the opportunity to play Poker online in India. In this article, we explore how can Indians play poker online with ease and without any hassle.

First things first and the big question is whether or not playing Poker online is legal in India. Well, according to a Supreme Court order passed in 2015, card games like Rummy and Poker have been deemed to be games of skill and not luck and hence, playing them with stakes involved should be allowed.

Interestingly, the Bangalore High Court had earlier deemed that poker is a game of skill as well.

Now, there are other places where it’s mentioned that playing poker online is different from playing poker in clubs but it’s still a grey area that you would need to consult before you decide to play poker online in India.

In the long run, every player is just as likely to get pocket aces, but even the skilled players with an inferior hand can defeat such a pair.

This is evident from Phil Hellmuth’s accomplishment, who has won the World Series of Poker Bracelet a record 14 times. If poker were indeed a game of chance, then the odds of him repeating such a feat after the first time would have been astronomical. In layman’s terms, he would have to be God Himself, to get lucky 14 times.

The fact that poker is a game of skill has put the business of online poker in India, in grey area. The gambling in India is governed by the Public Gambling Act, 1867, which essentially prohibits gambling. But the Section 12 of the act reads that this act will not be applied to any game, involving skill.

Moreover, as long as the tax deduction at source (TDS) occurs, with no foreign investment or technical collaboration involved in the project, online gambling of skill games is fine.

Even though poker hasn’t been deemed as a skilled game, no strict action has been taken against the online sites running poker. But to put your mind at ease, the prominent online poker sites have gone through the legal paperwork to ensure that poker is deemed to be a skilled game. However, certain states have their own laws related to gambling, which do prevail over the Public Gambling Act, 1867. For instance, residents of Assam and Orissa can’t gamble online, since their state laws prohibits them to do so.
